WASHINGTON, DC – Senator James Lankford’s (R-OK) Guidance Clarity Act, which clarifies that federal agency guidance documents are not legally binding, passed the House of Representatives today. This legislation unanimously passed the Senate and now heads to the White House for the president’s signature.
“Government should serve its citizens, not the citizens serving the government. Already facing record high inflation and historic supply chain issues, Oklahoma small business owners do not have time or resources to spare,” said Lankford. “My legislation will make running a small business easier by clarifying confusing federal regulations and putting common-sense solutions in place. The Guidance Clarity Act is a huge win for the small business community, and I look forward to the president signing it into law.”

Inflation, supply chain issues, and labor shortages have made it exceedingly difficult to be a small business owner right now. These are people who don’t have time to worry about keeping track of the latest government red tape… The Guidance Clarity Act is a simple, straightforward solution. This bill will help regulators do their jobs more efficiently and help small businesses, who lack the resources to employ teams of expensive lawyers, continue to strengthen our workforce and economy,” said Congressman Blaine Luetkemeyer (R-MO) who led the House version of this bill.
Experts have often referred to guidance documents as regulatory dark matter, which unlike other regulatory actions are not required to go through the public notice-and-comment process. Lankford introduced the Providing Accountability Through Transparency Act (PATTA) and the Guidance Clarity Act to help increase transparency of the federal rulemaking process for all Oklahomans, particularly small businesses. Lankford serves as Ranking Member of the Senate Homeland Security and Governmental Affairs Committee’s Subcommittee on Government Operations and Border Management.
