The NBA has investigated owners and forced a sale after outrageous comments before, and it even moved the All-Star game to protest a North Carolina law saying boys and girls shouldn’t use the same bathroom. The league will prove itself greedy, spineless, and hypocritical if it doesn’t force Palihapitiya to sell his interest in the Warriors.”

Capito, Manchin Announce Funding Opportunity for Rural Communities Opioid Response Program, Behavioral Health Support Services

WASHINGTON, D.C. – U.S. Senators Shelley Moore Capito (R-W.Va.) and Joe Manchin (D-W.Va.), both members of the Senate Appropriations Committee, today announced the availability of $13 million in funding for the Rural Communities Opioid Response Program (RCORP) and Behavioral Health Care Support (BHS) program through the U.S. Department of Health and Human Services’ (HHS) Health Resources and Services Administration (HRSA) and encourage West Virginia entities to apply. This program aims to increase access to behavioral health care services and address health inequities in rural America, including through evidence-based, trauma-informed treatment for substance use disorder.

“In our battle against the addiction crisis, we must continue to connect West Virginia’s substance use and prevention organizations with the resources they need. The allotment announced today can help create healthier and safer communities, and I encourage eligible applicants to take advantage of these programs. The opioid epidemic has touched all of us in one way or another, and I will continue to advocate for the support our local leaders need to pursue solutions that will help West Virginians struggling with addiction get the help they need,” Senator Capito said.

“Every West Virginian has been impacted by substance use disorder, and combatting this heartbreaking epidemic continues to be a top priority of mine. The Rural Communities Opioid Response Program–Behavioral Health Care Support (BHS) program provides critical funding to rural health clinics to address and combat substance use disorder. And now six West Virginia counties are eligible to apply for this funding after I fought to change the classification system that previously kept these rural West Virginia counties from accessing crucial healthcare funding. I encourage every eligible health center to apply for this integral funding, and I will continue to work with HHS to provide additional resources to combat the drug epidemic in the Mountain State,” Senator Manchin said.

BACKGROUND:

HRSA released a Notice of Funding Opportunity (NOFO) for the FY 2022 BHS program. RCORP is a multi-year initiative administered by HRSA aimed at reducing the morbidity and mortality of substance use disorder (SUD), including opioid use disorder (OUD), in high risk rural communities. The purpose of this program is to advance RCORP’s overall goal by improving access to and quality of SUD and other behavioral health care services in rural communities. Recipients will increase access to behavioral health care services and address social determinants of health and health disparities in rural America, including through evidence-based, trauma-informed treatment for substance use disorder. Eligible applicants include entities such as Rural Health Clinics, federally recognized Tribes, Tribal organizations, and community and faith-based organizations.

WASHINGTON – More than 35 small and medium tech companies including Yelp, Sonos, Patreon, Y Combinator, and DuckDuckGo sent a letter to the Senate Judiciary Committee urging it to advance legislation led by Senators Amy Klobuchar (D-MN) and Chuck Grassley (R-IA) to stop major digital platforms from unfairly preferencing their own products or services.

“Findings from the United States and governments around the world reveal the many anticompetitive self-preferencing tactics dominant technology companies use to attain and entrench their gatekeeper status in the market to the detriment of competition, consumers, and innovation,” the companies wrote. 

They continued: “The American Innovation and Choice Online Act, co-sponsored by Senators Klobuchar and Grassley, targets self-preferencing to help restore competition in the digital marketplace and remove barriers for consumers to choose the services they want.”

POLITICO reported that many of the signers, including the startup incubator Y Combinator, are “new to the antitrust fight,” signaling growing momentum for the American Innovation and Choice Online Act. Introduced by Klobuchar and Grassley in October, this legislation will restore competition online by establishing common sense rules of the road for dominant digital platforms to prevent them from abusing their market power to harm competition, online businesses, and consumers.

We, the undersigned companies and individual, write to urge the U.S. Senate Committee on the Judiciary to favorably report S. 2992, the American Innovation and Choice Online Act. Findings from the United States and governments around the world reveal the many anticompetitive self-preferencing tactics dominant technology companies use to attain and entrench their gatekeeper status in the market to the detriment of competition, consumers, and innovation. The American Innovation and Choice Online Act, co-sponsored by Senators Klobuchar and Grassley, targets self-preferencing to help restore competition in the digital marketplace and remove barriers for consumers to choose the services they want.

Dominant technologies companies’ ability to give their own products and services preferential placement, access, and data on online platforms and operating systems prevents companies like us from competing on the merits. For example, due to their gatekeeper status, dominant technology companies can: use manipulative design tactics to steer individuals away from rival services; restrict the ability of competitors to interoperate on the platform; use non-public data to benefit the companies’ own services or products; make it impossible or complicated for users to change their default settings or services or uninstall apps. These tactics not only harm competition, but also deprive consumers of the innovative offerings a vibrant market would yield.

For too long, dominant technology companies have made it difficult for other businesses to compete in the digital marketplace by abusing their gatekeeper status to give themselves and their partners preferential treatment and access on their platforms. The Committee must act now to restore competition to the digital marketplace by voting “aye” on favorably reporting Senate Bill S. 2992, the American Innovation and Choice Online Act.

WASHINGTON – At a press conference following a meeting with Ukraine President Volodymyr Zelenskyy, U.S. Senator Amy Klobuchar (D-MN) reiterated the United States’ strong bipartisan support for Ukraine as it continues to face Russian aggression. “We know the administration from every level, the U.S. administration from the Secretary of State to the President himself, have pledged to help this country,” Klobuchar said.

Klobuchar also spoke about actions the U.S. is prepared to take in defense of Ukraine, including implementing sanctions against Russia. “Our message is there will be consequences if he chooses to violate the sanctity of this democracy…Congress is looking at additional sanctions that are not yet authorized by law,” she said, referring to legislation she and 38 of her colleagues introduced last week to impose steep costs for Russia in the event of a renewed Kremlin invasion of Ukraine.

Klobuchar announced this morning that she and a bipartisan group of colleagues, including Senators Rob Portman (R-OH), Jeanne Shaheen (D-NH), Chris Murphy (D-CT), Kevin Cramer (R-ND), Roger Wicker (R-MS), and Richard Blumenthal (D-CT), traveled to Ukraine to meet with President Zelenskyy.

“I’m Senator Amy Klobuchar from the state of Minnesota. I’m proud to be part of this delegation. At a moment of a lot of political divides in Washington, D.C., which we could do an entire press conference about, we instead choose to be here in unity. And that is because we stand with Ukraine, we stand with the brave, brave people of Ukraine who have now lost – and I think it’s important for our country, for our citizens to know this – 14,000 people at the hands of Russia. 

“We were briefed by the embassy this morning. We know the administration from every level, the U.S. administration from the Secretary of State to the President himself, have pledged to help this country. And that means everything from the aid that has been given, the congressional work led by Senators Shaheen and Portman, and also the sanctions bill that Senator Menendez put forward. I’m one of the cosponsors but a number of us are focused on as we move forward. So our message is there will be consequences if he chooses to violate the sanctity of this democracy.”

“In the U.S., there’s two things going on. One is that the Biden administration is looking at what sanctions are within their power to implement, looking at section by section of the economy. And they’ve already committed to be looking at that. And those sanctions are only most effective, and can be effective, if we work with our allies. And so that’s the other piece of the negotiations and what’s happening.

“The other thing that’s happening that’s more in our control – the people up here – is that Congress is looking at additional sanctions that are not yet authorized by law. That is the bill that I referred to that Senator Menendez, the head of the Foreign Relations Committee, is leading. And those include personal limitations on travel and personal sanctions against individuals, including Vladimir Putin. So both things are at play in a serious way right now as the threats continue.”

KYIV, UKRAINE–U.S. Senators Chris Murphy (D-Conn.), a member of the U.S. Senate Foreign Relations Committee, Richard Blumenthal (D-Conn.), a member of the U.S. Senate Armed Services Committee, Rob Portman (R-Ohio) Jeanne Shaheen (D-N.H.), Kevin Cramer (R-N.D.), Amy Klobuchar (D-Minn.), and Roger Wicker (R-Miss.) on Tuesday met with Ukraine President Volodymyr Zelensky as part of their trip to Ukraine. During their meeting, the senators expressed strong solidarity with Ukraine in the face of increased Russian aggression, including further military buildup on the Ukraine/Russia border as well as the ongoing conflict in Donbas and purported annexation of Crimea. 

The senators expressed their deep concern over the buildup of Russia’s forces in and around Ukraine, and pledged to continue to support funding for Ukraine’s defense in the U.S. Senate. Discussions touched further needs Ukraine has for assistance to counter the Russian threat. The senators also discussed the need for Ukraine to continue its democratic reforms in order to position the country for membership in NATO.

The senators discussed increased funding for the Ukraine Security Assistance Initiative that recently passed Congress as part of the Fiscal Year (FY) 2022 National Defense Authorization Act. The initiative has been extended through 2022 and its funding has been increased from $250 to $300 million per year, with at least $75 million specifically designated for lethal assistance. The funds will be used to help train, equip, and provide support for the Ukrainian government and armed forces in their effort to defend their independence, sovereignty, and territorial integrity against Russian aggression. 

“Russia’s increasingly aggressive actions in and around Ukraine are deeply concerning, and it’s critical that Putin understands the United States stands with the Ukrainian people and their right to decide their own future. In our meeting with President Zelensky, we expressed our unwavering bipartisan support for Ukraine’s sovereignty and continued democratic reforms and reaffirmed our commitment to ensuring they have the defensive weapons system necessary to protect against a threatened Russian invasion,” said Murphy.

“Vladimir Putin has made the biggest mistake of his career in underestimating how courageously the people of Ukraine will fight him if he invades. Vladimir Putin’s plan is to divide, demoralize, and degrade democracy through a hybrid war of cyber, military action, and misinformation. But there will be consequences for this unprovoked aggression. America is bound to Ukraine by an unshakable dedication to freedom, independence and democracy. We will continue to stand with the people of Ukraine – unstintingly and unwaveringly – as they fight this battle,” said Blumenthal.

Rubio, Tenney Urge Senate Secretary, House Clerk to Reject Attempts by Chinese Communist Party to Silence American Publisher

Washington, D.C. — U.S. Senator Marco Rubio (R-FL) and U.S. Representative Claudia Tenney (R-NY) sent a letter to Cheryl Johnson, Clerk of the U.S. House of Representatives, and Sonceria Ann Berry, Secretary of the U.S. Senate, following reports that Hangzhou Hikvision Digital Technology Company (Hikvision) urged their offices to investigate Internet Protocol Video Market (IPVM) for supposed lobbying disclosure violations. In doing so, Hikvision attempted to exploit congressional processes to silence IPVM for its unfavorable reporting about the Chinese state-controlled video surveillance company.
 
“As Chinese state-backed and directed firms continue to feel pressure from various sanctions first implemented under the Trump Administration, Hikvision’s efforts to silence dissent using your offices will likely be replicated by other malign entities tied to the CCP,” the lawmakers wrote. “Congress should take no part in these efforts. We urge your respective offices to see Hikvision’s smear campaign against IPVM for what it is worth and to remain vigilant against future attempts to use your offices as a mechanism to chill free speech and silence dissent.”

Recent news reports have shed light on attempts by Hangzhou Hikvision Digital Technology Company (Hikvision), a Chinese state-controlled video surveillance firm, to use the offices of the House Clerk and Secretary of the Senate to bully Internet Protocol Video Market (IPVM), an American publisher, into silence for its unfavorable reporting about the company. Congressional ethics must always be maintained to the highest standards. However, we urge you to not allow our transparent and open system to be cynically exploited by firms like Hikvision, which has been sanctioned by the U.S. government for its implication “in human rights violations and abuses in the implementation of China’s campaign of repression, mass arbitrary detention, and high-technology surveillance against Uighurs, Kazakhs, and other members of Muslim minority groups in the XUAR.” 
 
As you may know, IPVM has conducted several thorough investigations exposing Hikvision and other companies’ involvement in the Chinese Communist Party (CCP) mass detention and surveillance of Uyghur populations in China’s Xinjiang region.  These findings, including on Hikvision’s creation of “ethnic sorting” features for its surveillance products, provided critical information to Congress and Federal Agencies, including the Federal Communications Commission (FCC), which recently added Hikvision to its “Covered List” of high-risk equipment and services. Now, with the enactment of the Secure Equipment Act (P.L. 117-55), which effectively allows the FCC to bar the importation or sale of any new products from companies such as Hikvision regardless of funding source, the firm is attempting to subvert the law by attacking the integrity of its critics, using a cohort of American legal and public relations firms to do its bidding. Congress must not fall victim to its dishonest scheme.

Rubio, Daines, Colleagues Introduce Resolution Designating January 16 as Religious Freedom Day

Washington, D.C. — U.S. Senators Marco Rubio (R-FL), Steve Daines (R-MT), and colleagues introduced a Senate Concurrent Resolution (S.Con.Res.27) designating January 16, 2022 as Religious Freedom Day. The resolution commemorates the 236th Anniversary of the Virginia Statute for Religious Freedom, a landmark achievement that laid the foundations for the First Amendment.
 
Thomas Jefferson wrote the Virginia Statute for Religious Freedom, which passed the Virginia General Assembly on January 16, 1786. Many historians credit the language of Jefferson’s Statute for inspiring the groundwork for the First Amendment.

The full text of the resolution is below. 

Affirming the importance of religious freedom as a fundamental human right that is essential to a free society and protected for all people of the United States under the Constitution of the United States, and recognizing the 236th anniversary of the enactment of the Virginia Statute for Religious Freedom.  

Whereas the democracy of the United States is rooted in the fundamental truth that all people are created equal, endowed by the Creator with certain inalienable rights, including life, liberty, and the pursuit of happiness; 

Whereas the freedom of conscience was highly valued by— 

(1) individuals seeking religious freedom who settled in the colonies in the United States;(2) the founders of the United States; and (3) Thomas Jefferson, who wrote in a letter to the Society of the Methodist Episcopal Church at New London, Connecticut, dated February 4, 1809, that ‘‘[n]o provision in our Constitution ought to be dearer to man than that which protects the rights of conscience against the enterprizes of the civil authority’’; 

Whereas the Virginia Statute for Religious Freedom was— 

(1) drafted by Thomas Jefferson, who considered the Virginia Statute for 

Religious Freedom to be one of his greatest achievements; 

(2) enacted on January 16, 1786; and 

(3) the forerunner to the Free Exercise Clause of the First Amendment to the Constitution of the United States; 

Whereas section 2(a) of the International Religious Freedom Act of 1998 (22 U.S.C. 

6401(a)) states that— 

(1) ‘‘[t]he right to freedom of religion undergirds the very origin and existence of the United States’’; and 

(2) religious freedom was established by the founders of the United States ‘‘in law, as a fundamental right and as a pillar of our Nation’’;

Whereas the role of religion in society and public life in the United States has a long and robust tradition; 

Whereas individuals who have studied the democracy of the United States from an international perspective, such as Alexis de Tocqueville, have noted that religion plays a central role in preserving the Government of the United States because religion provides the moral base required for democracy to succeed;

Whereas, in Town of Greece v. Galloway, 134 S. Ct. 1811 (2014), the Supreme Court of the United States affirmed that ‘‘people of many faiths may be united in a community of tolerance and devotion’’; 

Whereas the principle of religious freedom ‘‘has guided our Nation forward’’, as expressed by the 44th President of the United States in a Presidential proclamation on Religious Freedom Day in 2011, and freedom of religion ‘‘is a universal human right to be protected here at home and across the globe’’, as expressed by that President of the United States on Religious Freedom Day in 2013;  

Whereas ‘‘[f]reedom of religion is a fundamental human right that must be upheld by every nation and guaranteed by every government’’, as expressed by the 42nd President of the United States in a Presidential proclamation on Religious Freedom Day in 1999; 

Whereas the First Amendment to the Constitution of the United States protects— 

(1) the right of individuals to freely express and act on the religious beliefs of those individuals; and 

(2) individuals from coercion to profess or act on a religious belief to which those individuals do not adhere;  

Whereas ‘‘our laws and institutions should not impede or hinder but rather should 

protect and preserve fundamental religious liberties’’, as expressed by the 42nd President of the United States in remarks accompanying the signing of the Religious Freedom Restoration Act of 1993 (42 U.S.C. 2000bb et seq.);  

Whereas, for countless people of the United States, faith is an integral part of every aspect of daily life and is not limited to the homes, houses of worship, or doctrinal creeds of those individuals; 

Whereas ‘‘religious faith has inspired many of our fellow citizens to help build a better Nation’’ in which ‘‘people of faith continue to wage a determined campaign to meet needs and fight suffering’’, as expressed by the 43rd President of the United States in a Presidential proclamation on Religious Freedom Day in 2003; 

Whereas, ‘‘[f]rom its birth to this day, the United States has prized this legacy of religious freedom and honored this heritage by standing for religious freedom and offering refuge to those suffering religious persecution’’, as noted in section 2(a) of the International Religious Freedom Act of 1998 (22 U.S.C. 6401(a)); 

Whereas Thomas Jefferson wrote— 

(1) in 1798 that each right encompassed in the First Amendment to the Constitution of the United States is dependent on the other rights described in that Amendment, ‘‘thereby guarding in the same sentence, and under the same words, the freedom of religion, of speech, and of the press: insomuch, that whatever violated either, throws down the sanctuary which covers the others’’; and 

(2) in 1822 that the constitutional freedom of religion is ‘‘the most inalienable and sacred of all human rights’’; 

Whereas religious freedom ‘‘has been integral to the preservation and development of the United States’’, and ‘‘the free exercise of religion goes hand in hand with the preservation of our other rights’’, as expressed by the 41st President of the United States in a Presidential proclamation on Religious Freedom Day in 1993; and 

Whereas we ‘‘continue to proclaim the fundamental right of all peoples to believe and worship according to their own conscience, to affirm their beliefs openly and freely, and to practice their faith without fear or intimidation’’, as expressed by the 42nd President of the United States in a Presidential proclamation on Religious Freedom Day in 1998: Now, therefore, be it 

Resolved by the Senate (the House of Representatives concurring), That Congress— 

(1) on Religious Freedom Day on January 16, 2022, honors the 236th anniversary of the enactment of the Virginia Statute for Religious Freedom; and 

(2) affirms that— 

(A) for individuals of any faith and individuals of no faith, religious freedom includes the right of an individual to live, work, associate, and worship in accordance with the beliefs of the individual; 

(B) all people of the United States can be unified in supporting religious freedom, regardless of differing individual beliefs, because religious freedom is a fundamental human right; and 

C) ‘‘the American people will remain forever unshackled in matters of faith’’, as expressed by the 44th President of the United States in a Presidential proclamation on Religious Freedom Day in 2012.

Young, Wicker Applaud FMCSA Advancement of 18 to 21-Year-Old Truck Driver Pilot Program

“My DRIVE-Safe pilot program will address the driver shortage, provide new career opportunities for young Hoosiers and Americans, and make the roads safer,” – Sen. Young.

WASHINGTON – U.S. Senators Todd Young (R-Ind.) and Roger Wicker (R-Miss.) applauded the Federal Motor Carrier Safety Administration (FMCSA) for advancing the 18 to 21-year-old truck driver pilot program. 

This program will allow 18 to 21-year-old truck drivers to operate in interstate commerce, as they currently do in intrastate commerce. The pilot program includes a number of safety requirements, such as advanced technology in trucks, an accompanying experienced driver, and the participation of motor carriers with a safe record.

“Today, 18-year-olds can drive more than 200 miles from New Albany to Gary and back, but they aren’t allowed to drive two miles from New Albany to Louisville,” said Senator Young. “My DRIVE-Safe pilot program will address the driver shortage, provide new career opportunities for young Hoosiers and Americans, and make the roads safer. We have faced a truck driver shortage for years, but it has now reached a crisis level as we witness major supply chain bottlenecks across all sectors. I commend the Federal Motor Carrier Safety Administration for acting swiftly to establish this program.” 

“If a 19-year-old can safely drive a truck from one end of our state to the other, federal law should allow the same young American to drive across state lines,” said Senator Wicker. “Implementation of this important provision will help address driver workforce challenges, which are particularly important given the ongoing supply chain transportation disruptions. Though I have concerns about the Registered Apprenticeship program requirement, I appreciate FMCSA’s work to advance this important program.”

The 18 to 21-year-old truck driver pilot program was based on Senator Young’s DRIVE-Safe Act, which was introduced in February 2019. The pilot program was included in the Senate Commerce Committee’s Surface Transportation Investment Act that was part of the bipartisan infrastructure law.
