WASHINGTON—U.S. Senator Kevin Cramer (R-ND), member of the Senate Environment and Public Works (EPW) Committee, issued the following statement after the Environmental Protection Agency (EPA) proposed its most-restrictive climate rules for the power sector, which would require coal and many gas-fired plants to capture most of their emissions.

“What the Democrats are either ignoring or do not understand is they’re operating outside the confines of the law and completely ignoring Supreme Court precedent in West Virginia v. EPA, which North Dakota was a party to. They are are pushing an unlawful policy and will have to explain to the American people why they support energy costs going up while reliability plummets. It’s not a durable plan.

“My message to the administration is simply this: stay within the confines of the law and the Constitution, and withdraw this rule immediately.”

Once published in the Federal Register, the rules will be open for public comment for 60 days. EPA has plans to finalize the proposal by June 2024.
